We are delighted to announce that Nathan Tavares QC, Mark Mullins and Simon Burrows have been authorised to sit as fee paid judges of the Court of Protection. They will deal with both health & welfare and property affairs cases. At the recent Court of Protection Practitioners Association annual conference in Manchester, Vice President of the Court, Mr Justice Hayden, said that the quality of applications for this recruitment exercise was the highest he had seen in any comparable competition. He welcomed the experience that new appointees to the Court would bring. Nathan, appointed QC this year, is a specialist clinical negligence and personal injury practitioner. Nathan Tavares represented the family of Jérôme Roussel at the Inquest into his death on Thursday 9th November 2017. Jérôme, a 51 year old trader in the City, was cycling to work at 6.45 am on 2nd May 2017, when he collided with the rear of an articulated lorry which was parked in the cycle lane on Pentonville Road. He suffered fractures in his neck as a result of the collision and underwent major surgery at the Royal London Hospital the following day. Without ever having left hospital, he developed a series of complications including sepsis, from which he died on 25th June 2017. The coroner recorded a verdict of accidental death. Christopher Wilson-Smith QC and Nathan Tavares successfully obtained substantial damages against a Health Trust for a claimant who sustained permanent paraplegia following delayed diagnosis of a spinal abscess. Quantification of the Claimant’s case presented a number of challenging problems because of his drug dependency and associated loss of capacity. The Judgment can be read here.

Nathan Tavares successfully defended Hickstead Ltd, hosts of the Royal International Horse Show, against the claim of Mr Lear, a participant injured when the ramp of his horsebox fell on him causing paraplegia. Mr Lear was a competitor at the Longines Royal International Horse Show, at the Hickstead Showground, Sussex, on 30th July 2011. He was permitted to park his 18 tonne horsebox in a field designated for horseboxes and left it’s rear ramp lowered. He returned to the vehicle about 4 hours later and found that the ramp had been raised and shut. He proceeded to open it and the ramp fell down on him with great force, resulting in fractures to his spine which have rendered him paraplegic.…

Nathan Tavares of Outer Temple Chambers and William Norris QC of Thirty Nine Essex Street, instructed by Paul Paxton of Stewarts Law LLP, acted for Agnes Collier who has been awarded record damages (for a personal injury claim) in the High Court. Agnes, who was 13 at the time of her accident, and is now 17, suffered very serious spinal injuries leaving her tetraplegic and wholly dependent on others for her care and the needs of everyday life. She also lost her mother who was killed in the same accident.
