No evidence offered against a very large organisation represented by Oliver Powell 

Oliver Powell, led by Prashant Popat KC of Henderson Chambers, and instructed by Mike Grant and James Muller of Weightmans, acted for a very large organisation. Their client was indicted before Chester Crown Court on two counts pursuant to the Regulatory Reform (Fire Safety) Order 2005. Following service of a 27-page Defence Statement, expert report and written representations, Cheshire Fire Rescue Authority (‘CFRA’) agreed to offer no evidence against their client. Background On 8 August 2019, the Beechmere retirement village in Crewe was destroyed by fire. More than 150 residents lost their homes and possessions. The fire was one of the biggest ever attended by Cheshire Fire and Rescue Service (‘CFRS’) with 70 firefighters deployed at its height to bring…

Silk Appointments: Oliver Powell and Ben Bradley

We are delighted to announce that Oliver Powell and Ben Bradley have been elevated to the ranks of King’s Counsel (Silk) in the 2024 King’s Counsel competition Appointments to King’s Counsel do not come easy and are offered to a very carefully selected shortlist of applicants just once a year. Following a recommendation by the Lord Chancellor, The Right Honourable Shabana Mahmood MP, The King has approved her recommendation that Oliver Powell and Ben Bradley should both be appointed His Majesty’s Counsel.  The King’s Counsel Selection Panel made its recommendations to the Lord Chancellor after considering very carefully the evidence from application forms, assessments, and interviews with applicants. James Leonard KC and Oliver Powell, instructed by Simon Belfield of DWF, appeared on behalf of the Maritime & Coastguard Agency (‘MCA’), at Southampton Crown Court. After a 4 ½ week trial, a jury unanimously convicted Intrada Ships Management Ltd of failing to take all reasonable steps to secure that a ship was operated in a safe manner. Background On 13 December 2021, at about 3.25am UK time, the Scot Carrier, a UK registered general cargo vessel, and the Karin Høj, a Danish registered barge, were in the Baltic Sea just off the South coast of Sweden. They had just reached the southerly end of the Bornholm Traffic Separation Scheme (‘TSS’) and were both heading in the same south-westerly direction.…

Fiona Horlick KC, leading Oliver Powell, appear on behalf of CEO of Care Home Provider

Fiona Horlick KC and Oliver Powell, instructed by Andrew Oliver of Andrew Jackson LLP, appeared on behalf of a care home provider at Teesside Crown Court. Following applications made by Fiona and Oliver (& other co-defending counsel), the CPS offered no evidence. Background: between 2016 and 2017, 5 service users, who were residents at two care homes owned by the care provider, passed away. The 8 defendants faced an indictment containing 19 counts arising from the circumstances in which the 5 people died. The deceased were all residents in care homes. Outer Temple barristers James Counsell KC and Oliver Powell will be providing advanced advocacy skills training as part of the DIFC Laws Certificate programme. This training will take place on 4th to 5th September 2023. The DIFC Academy are hosting a course named ‘Advanced Advocacy Skills‘ which is part of the DIFC Laws Certificate programme. This comprehensive training explores the application of traditional advocacy skills to activities routinely performed by lawyers. There will be series of both unassessed and assessed advocacy exercises. These exercises take the form of mock hearings covering submissions (written and oral), witness handling and general advocacy tips. They serve as useful refreshers for courtroom skills.
