Oliver Powell speaks at UKHMA Autumn 2017 Seminar

Oliver Powell, together with Claire Rawle, Partner Blake Morgan LLP, were both invited to speak at UK Harbour Masters Association Autumn 2017 Seminar. Their talk, entitled ‘Health & Safety – the cost of getting it wrong’, drew upon their considerable experience of investigations and prosecutions in health and safety matters. Sentencing Guidelines and Prosecution of Individuals in Health & Safety cases

The Health and Safety Lawyers Association (“HSLA”) spring seminar programme attracted over 150 delegates across three separate seminars this year. James Leonard, Paul Rogers, Tim Green and Oliver Powell of Outer Temple Chambers provided key talks across the three seminars. They addressed the impact of the new sentencing guidelines and the increased prosecution by the HSE of individuals, to audiences in Bristol, London and Birmingham, with a Glasgow seminar scheduled for June. Oliver Powell appears before Privy Council

Oliver Powell, led by the Attorney General of Anguilla, appeared before the Judicial Committee of the Privy Council in the matter of the Superintendent of Prisons & Another v Hamilton [2016] UKPC 23. The Respondent, Neville Hamilton, was dismissed as the Deputy Superintendent of Prisons by the Governor of Anguilla, to whom charges that the Respondent had been in neglect of duty under s.2(d) of the Code of Discipline had been referred by the First Respondent. The power to refer charges to the Governor under s.7(2) of the Code was successfully challenged by the Respondent in judicial review proceedings before High Court of Justice of the Eastern Caribbean Supreme Court, Anguilla Circuit. Oliver Powell in Falklands Charterer fisheries investigation

Oliver Powell, instructed by Pinsent Masons, appeared for Sulivan Shipping Services Ltd (‘the Charterer’) in one of the largest fisheries investigations ever undertaken in the Falkland Islands. Oliver was retained throughout the investigation and the court proceedings, attending a number of hearings before the Court in the Falklands Island in December 2015 and by video link in 2016. Background: following a catch verification in Stanley in June 2015, it was discovered that Mr Baston (‘the Master’) of the FV Figaro had failed to declare 118,562.35kg of hake and had over declared 133,012.50kg of rock cod. Oliver Powell instructed in multi-million pound Confiscation Hearing

Oliver Powell, led by Senior Treasury Counsel, was instructed by the Crown Prosecution Service in confiscation proceedings that emanated from convictions in relation to the sale of fake bomb detectors. On 23 April 2013 Mr McCormick was convicted of three counts of fraud contrary to s.7(1) FA 2006 and was sentenced to ten years imprisonment. Owing to the fact that Mr McCormick had benefitted from his criminal conduct the Court directed that there be confiscation proceedings. At the hearing this week, HHJ Hone QC ordered that the benefit of Mr McCormick’s offending amounted to a sum in excess of £21 million and that Mr McCormick had realisable assets totalling nearly £8 million. Oliver Powell speaks at HMRC’s FPU Conference 2016

Oliver Powell was invited to speak at HMRC’s biannual FPU Conference. His talk was concerned with restraint and confiscation pursuant to the Proceeds of Crime Act 2002. Other speakers included inter alia Dave Standish & Nigel Spare of KPMG and Peter Maxwell & Sally Dallow of Bond Dickinson. The talk was attended by over 40 HMRC employees, including; lawyers, accountants and financial investigators. Outer Temple continues to lead the way in asset recovery and financial crime, both domestically and internationally.
