Sarah Crowther has recently authored an article in the Journal of Personal Injury Law, in which she examines EU law provisions that have obliged the UK to provide the victims of road traffic accidents (RTAs) with a direct right of action against the insurer of the vehicle involved, including in RTAs with a cross-border element. She proceeds to review case law addressing the jurisdiction issues that may be raised in direct rights cases and considers how the UK’s withdrawal from the EU might affect the direct rights regime. Sarah Crowther appeared as junior counsel for the respondent victim of a road traffic accident in Greece in 2011. Tiffany Moreno, a young mother was pushing a buggy along the side of a road in Greece, when she was struck by an uninsured vehicle which failed to negotiate the bend. She suffered devastating injuries to her legs, resulting in a below knee amputation of one leg. Tiffany is a Welsh resident and brought her claim against MIB under regulations passed by the UK in 2003 in order to comply with the 4th Motor Insurance Directive in respect of victims of uninsured vehicles in Europe. In 2015, Ashers bakery was found to have discriminated against a customer on the grounds of sexual orientation and political opinion. The complicated so-called ‘gay cake’ case seemed to be nearing its conclusion, when the last-minute postponement of the hearing extended the appeal issues. The Attorney General then intervened into the case claiming there was a potential conflict between Northern Ireland’s equality legislation and European human rights laws and that the case raised constitutional issues arising from the devolution arrangements in Northern Ireland. Further to this intervention, a special hearing will now take place on Wednesday, 3rd March 2016, and the appeal itself is re-listed to start on 9th May 2016.

Sarah Crowther has recently successfully acted in a multi-vehicle road accident case in which a man died and another has been injured after an uninsured driver crashed into them in Thais, France. The men were waiting at the side of the road for a wheel on their car to be changed by a local recovery truck driver when the accident took place. The claim has been made by the wife of the man who died in the accident and a judgment was handed down on Friday, 27 November 2015.
