Outer Temple Chambers members to attend Dubai Arbitration Week

11 members of the Outer Temple International Team will attend Dubai Arbitration Week, (DAW 22) between 14th & 18th November 2022. Outer Temple’s; David Russell KC, Andrew Spink KC, Philip Punwar, Justina Stewart, David Holloway, Sean Yates, Peter Linstead, Stephen Doherty, Lucian ILIE, Anson Cheung, and Sam Carter will be joining delegates at this year’s Dubai Arbitration Week. DIFC Court of Appeal dismiss the claim in Massun v Mousi & Ors.

After a long running dispute, the DIFC Court of Appeal has dismissed the claim in Massun v Mousi & Ors. Outer Temple members, David Russell KC and Stephen Doherty, acted for the Second and Third Defendants. Cyber-Fraud, Third Party Fraudsters, and the Expansion of the Quincecare Duty

Stephen Doherty explores some recent cases involving “Quincecare Duty”, which has existed for over thirty years, and what these new precedents mean for modern banking fraud cases. “Quincecare Duty” was established in Barclays Bank plc v Quincecare Ltd [1992] 4 All ER 363, and tells us that a bank or financial institution may be liable for processing a fraudulent transaction if the bank has reasonable grounds for believing that there has been an attempt to defraud its customer. James Counsell QC and Stephen Doherty, instructed by Leonora Riesenburg at INTADR, have been successful before the DIFC Court of Appeal in its recent judgment in Lakhan v Lamia [2021] CA 001.   The DIFC Court of Appeal has dealt a blow to recalcitrant parties seeking to invoke the jurisdiction of the Joint Judicial Committee (“JJC”) in an attempt to obstruct proceedings before the DIFC Courts. In Lakhan, the Court of Appeal has revised its historical practice of automatically staying proceedings upon petitions being made to the JJC, by confirming that, in order for any stay to take effect, there must first be a positively determined “conflict of jurisdiction”, and the mere existence of two sets of proceedings before the DIFC Courts and the onshore…

Stephen Doherty Obtains $50 million DIAC Arbitration Award

Acting as sole counsel, Stephen has successfully obtained an award for $50 million (USD) in two linked arbitrations for a Dubai-based developer, in proceedings under the rules of the Dubai International Arbitration Centre (DIAC). As part of the same set of proceedings, Stephen also successfully defended a substantial counterclaim exceeding $150 million (USD) in value. The dispute concerned delays to a master developer’s obligations to the sub-developer, particularly in relation to plot hand-over and the provision of infrastructure. It is one of a number of property disputes in which Stephen has successfully acted for parties in the GCC region, arising in the wake of the 2008-09 financial crisis. Stephen was instructed by Adv. Stephen Doherty successful in $14 million Dubai arbitration

Stephen recently acted for a high profile master developer in proceedings under the rules of the Dubai International Arbitration Centre (DIAC). The arbitration related to the sale and development of commercial real estate, and the provision of infrastructure by the master developer. Stephen acted as lead counsel over the course of a four day hearing, which heard evidence from a number of expert witnesses, and successfully obtained an award exceeding $14 million on behalf of his client. Stephen has recently returned to chambers following a secondment to the arbitration team of a leading UAE law firm.
