Teresa Rosen Peacocke and Gabor Bognar successfully appealed the first instance decision in the Court of Appeal, in the case of Gosden v Halliwell Landau (A Firm). As a result, the Claimants/Appellants are now entitled to recover damages for professional negligence against solicitors who acted for the First Appellant’s mother, now deceased, in the creation of an estate-planning scheme which the Defendants promoted as having Inheritance Tax advantages. The scheme included the creation of trusts, into one of which the mother’s home was to be transferred. Teresa Rosen Peacocke has authored an article published in the Trust Quarterly Review, titled ‘Under the Influence’. The article is a discussion of two England and Wales cases and the relationship necessary to raise a presumption of undue influence. Teresa discusses two contrasting cases concerning the question of whether there are limits in principle on when and how a relationship of influence can arise for the purposes of the doctrine of presumed undue influence. The first case Teresa examines is Macklin v Dowsett, in which the England and Wales Court of Appeal allowed an appeal on the basis that a relationship of influence sufficient to ground a finding of presumed undue influence arose in the course of the transaction under scrutiny.…

On Friday 18 January 2019, members of Outer Temple Chambers spoke at the 2019 New York State Bar Association Annual Meeting in New York. As part of the schedule, the panel spoke on ‘International Litigation – Introduction and Overview of the English Legal System’. The lively discussion involved an examination of the similarities and differences between the Bar of England and Wales, and the New York State Bar. Teresa Rosen Peacocke successfully applied to the Queens Bench Division to set aside an Order under the Evidence (Proceedings in Other Jurisdictions) Act 1975. This was made against two UK pharmaceutical companies and their directors for disclosure of documents and submission to a US style deposition in aid of a California action by the pharmaceutical giant Allergan, maker of Botox, against a website known as Amazon Medica. A US District Court Judge has granted the Motion filed by Teresa Rosen Peacocke to dismiss the claim by pharmaceutical conglomerate Abbott Laboratories and related companies, against a UK based company and its principals on the basis that the court lacked personal jurisdiction over these defendants. In this case, Abbott seeks relief against 300 defendants, including several foreign entities and individuals, for the allegedly unlawful importation, distribution and sale of international medical device products, as part of an alleged conspiracy to defraud Abbott and US insurers and in breach of federal trademark legislation.
