Robert Rhodes QC is due to speak at the International Dispute Resolution Conference 2019 in Hong Kong, on 17th April 2019. The Hon Mrs Carrie Lam, Chief Executive of the Hong Kong Special Administrative Region, will open the event. The Global Arbitration Review (GAR) and the Chartered Institute of Arbitrators (CIArb) held an event in London this month to mark the launch of the new GAR-CIArb Seat Index – which is now live and ready to access. The launch, held at Reed Smith in London on 15 November, featured a panel discussion by CIArb’s Doug Jones, Lord Goldsmith QC and Professor Janet Walker of Outer Temple Chambers, who led work on the project, following an introduction by GAR’s publisher David Samuels. International Chambers of Commerce, Canada (ICC Canada) has announced new women leaders of its arbitration committee and held a dinner to honour leading arbitrator Marc Lalonde QC – who received praise from Prime Minister Justin Trudeau among others. The committee said that it has appointed Tina Cicchetti as its first female chair and Janet Walker as vice-chair who will take over as chair after Cichetti’s two-year term ends, meaning the leadership will be female for the next four years. Benjimin Burgher successfully represented the Partner of an LLP during her Arbitration Proceedings in the IDRC. The Partner was found to be wrongfully expelled by the LLP and awarded her equity, tranche payments and costs. In the lengthy arbitration proceedings the Partner’s contentions relating to construction of the LLP Agreement, valuation of her equity and outstanding entitlements were considered resulting in the favourable award. The Respondent’s arguments on contractual construction, estoppel by convention, the interpretation of good faith and dishonesty were rejected. The case emphasised the importance and necessity of effective drafting of LLP Agreements in regulating the relationship between the parties. They also act for these clients to challenge claims that a US court has jurisdiction over them. In her most recent article, Teresa Rosen Peacocke discusses recent efforts by plaintiffs to expand the definition of specific jurisdiction (requiring a foreign defendant’s US activities to have given rise to the plaintiff’s claim) so that a defendant’s general activities can be linked to a claim on the basis of a ‘sliding scale’.
