Tom Gibson recently wrote an article – ‘A Costs Budgeting Horror Story’ – about a (true) story of a costs budget being struck out for a technical error in an early post-Jackson personal injury case. The article was published in PI Brief Update and is available at http://www.pibriefupdate.com/content/law-journal-summaries/news-category-2-53514/2250-a-costs-budgeting-horror-story-tom-gibson-outer-temple-chambers Since the article was published, several other stories of costs budgets being struck out – or not struck out – for exactly the same technical error (with a budget’s statement of truth wording) have emerged from county courts around the country. With several appeals currently in progress, 2014 looks set to be a busy year for early post-Jackson case law.

We are delighted to announce that last night (3 Oct 2013) at the Chambers & Partners UK Bar Awards, Outer Temple was declared ‘Personal Injury / Clinical Negligence Chambers of the Year’ and that David Morris was awarded ‘Professional Discipline Junior of the Year’. The Personal Injury and Clinical Negligence teams earlier this month won the inaugural Legal 500 UK Award 2013 confirming Outer Temple’s dominance in this area of law. Outer Temple was also a finalist in the category Professional Discipline Set of the Year, a category won in 2012.

Two members of Chambers (instructed by Rebecca Dixon of Stewarts Law LLP) have recently been involved in assisting an Australian national to obtain a significant award before the First-Tier Tribunal (Criminal Injuries Compensation). The Appellant was injured in an unprovoked attack in London in 2004, which caused the client to suffer a brain injury. The CICA had initially contended that the Appellant was not entitled to any form of award at all by reason of his alleged conduct prior to the incident. Stephen Climie represented the Appellant at the eligibility hearing. AD was injured in a road traffic accident in 2005 when she was 7. Liability was promptly admitted but the task of investigating her claim for catastrophic injury was considerable. After the preparation and exchange of evidence settlement meetings proved unproductive; although the Defence Insurer made an offer of £5M (including periodical payments to be agreed) which was followed up by a Part 36 offer in that sum.

Nathan Tavares of Outer Temple Chambers and William Norris QC of Thirty Nine Essex Street, instructed by Paul Paxton of Stewarts Law LLP, acted for Agnes Collier who has been awarded record damages (for a personal injury claim) in the High Court. Agnes, who was 13 at the time of her accident, and is now 17, suffered very serious spinal injuries leaving her tetraplegic and wholly dependent on others for her care and the needs of everyday life. She also lost her mother who was killed in the same accident. Gerard McDermott QC gave a presentation at the Pan-European Organisation of Personal Injury Lawyer’s conference which was held in Berlin on Saturday 15th September 2012. Participating in this conference reflects Gerard’s increasing Travel Law practice, particularly in personal injury abroad cases. The topic of Gerard’s presentation was “Medical Experts, their Role, Responsibilities and the Procedure Governing them”. The presentation including discussion of the role of expert witnesses across many jurisdictions was warmly received and provided a comprehensive overview of the laws governing expert witnesses across the world to a multi-national audience.

James Counsell reports: On 26 July 2012, the Court of Appeal (Lord Judge LCJ, Lord Neuberger (MR) and Sir Maurice Kay (VP CA Civ)) announced an increase in the level of PI and other general damages by 10% to reflect the recommendations of the Jackson report and to anticipate the entry into force of the Legal Aid, Sentencing and Punishment of Offenders Act 2012.
