Robert Dickason and Joshua Hitchens successfully secure dismissal of Contempt proceedings

Robert Dickason and Joshua Hitchens have secured the dismissal of Contempt Proceedings arising out of the widely reported case of Muyepa v Ministry of Defence [2022] EWHC 2648 (KB). Robert Dickason and Joshua Hitchens, instructed by Marc Livingston, Simon Barker and Catriona Virden of Janes Solicitors, have secured the dismissal of Contempt Proceedings brought against their clients, Brian and Racheal Muyepa. The Proceedings, which arose out of Mr. Muyepa’s record £3.7m claim for non-freezing cold injuries against the Ministry of Defence, will now not proceed to trial, meaning that Mr. and Mrs. Muyepa will not be found guilty of Contempt of Court and will not face the prospect of being committed to prison for Contempt of Court. In this presentation, Ian Denham discusses his role in the Inquest that followed the deaths of two women following an outbreak of the Mycobacterium Abscessus pathogen at the Royal Papworth Hospital in Cambridge. The background Karen Starling, aged 54, and Anne Martinez, aged 65, both tested positive for Mycobacterium Abscessus (MA) after successfully undergoing double lung transplants at the Royal Papworth Hospital. A NHS serious incident report found that 21 patients with lung conditions were infected with MA in the months after the specialist heart and lung hospital opened in May 2019.…

The Court of Appeal has handed down judgment in an important appeal in the case of FXF v (1) English Karate Federation Ltd, (2) David Jonathan Donovan, in which James Counsell KC and Olinga Tahzib act for the Claimant James and Olinga act for a Claimant (referred to as ‘FXF’ to protect her anonymity) – a highly successful karate athlete – who brings a claim for personal injury arising out of sexual abuse by her karate coach between 2008 and 2014. Earlier this week, James Counsell KC and Ben Bradley appeared on behalf of BXB in the Supreme Court in Trustees of the Barry Congregation of Jehovah’s Witnesses v BXB. Having previously won at trial, and subsequently in the Court of Appeal, James and Ben represented BXB at the Supreme Court in her claim that the Trustees of the Barry Congregation of Jehovah’s Witnesses are vicariously liable for a rape committed on her by Mark Sewell, one of the Elders of the Congregation. This case represents the return of vicarious liability to the Supreme Court for the first time since the seminal cases of Barclays Bank and Morrisons. Tom Gibson acts for successful claimant in ‘freak accident’ brain injury case

Tom Gibson acted recently for a claimant, a young high-flying teacher, who suffered a fractured skull and brain injury in a ‘freak’ road traffic accident.  While driving on the A1, a sheet of metal flew through her windscreen and sliced her skull open. Over the next few years, the claimant attempted, courageously but ultimately unsuccessfully, to return to her career as a senior teacher.  However, she eventually came to the very sad realisation that her teaching career – and her ambition to progress to being a headteacher – was over, due to the continuing effects of her brain injury.
