Global Arbitration Review – Chartered Institute of Arbitrators seat index launched in London

The Global Arbitration Review (GAR) and the Chartered Institute of Arbitrators (CIArb) held an event in London this month to mark the launch of the new GAR-CIArb Seat Index – which is now live and ready to access. The launch, held at Reed Smith in London on 15 November, featured a panel discussion by CIArb’s Doug Jones, Lord Goldsmith QC and Professor Janet Walker of Outer Temple Chambers, who led work on the project, following an introduction by GAR’s publisher David Samuels. The index aims to provide one-page summaries of the favourableness of individual arbitral seats assessed against a range of standard criteria. Nathan Tavares in City trader Inquest

Nathan Tavares represented the family of Jérôme Roussel at the Inquest into his death on Thursday 9th November 2017. Jérôme, a 51 year old trader in the City, was cycling to work at 6.45 am on 2nd May 2017, when he collided with the rear of an articulated lorry which was parked in the cycle lane on Pentonville Road. He suffered fractures in his neck as a result of the collision and underwent major surgery at the Royal London Hospital the following day. Without ever having left hospital, he developed a series of complications including sepsis, from which he died on 25th June 2017. The coroner recorded a verdict of accidental death. Child Sex Abuse Inquiry Case Study on Child Migration closes

Closing statements were delivered in the Independent Inquiry into Child Sexual Abuse’s case study into the Child Migration Programmes yesterday, in which Paul Livingston is Junior Counsel to the Inquiry. The Child Migration Programmes, which continued until the 1970s, involved children being migrated from care or voluntary institutions in England & Wales, and being placed in institutions abroad, mostly in Australia and Canada. The Case Study was set up to investigate the extent of institutional failings of Government departments, public authorities, and voluntary institutions, relating to the sexual abuse suffered by some child migrants. David Westcott QC in successful action for Claimant in Harris v Miller

David Westcott QC successfully acted for the Claimant in Harris v Miller [2016] EWHC 2438 (QB). The Claimant was 14 years old when she fell off the Defendant’s horse and sustained paraplegia. An action was originally brought in negligence and under the Animals Act 1971; but since, on the particular facts of the case, the Claimant could not have succeeded in the statutory claim if she failed at common law, only negligence was pursued at trial. The facts were hotly disputed by the parties. It was the Claimant’s case that the horse bucked whilst cantering on flat ground, whereas the Defendant suggested the horse had dipped its head when walking downhill. High-profile case discussed in APIL’s PI Focus

Mark Pollock, a blind adventure athlete and well-known motivational speaker, is now paraplegic after falling through a second floor window of a residential property. Instructed with Christopher Wilson-Smith QC by Ben Rogers, Partner at Stewarts Law, Matthew Stockwell acted for Mark Pollock in his successful claim against the householders’ insurer. The trial attracted widespread media attention in the UK and Ireland. The case raised a number interesting issues, in particular the duties owed to disabled visitors by an occupier, which are discussed in an article co-written by Matthew and Ben Rogers.
