David Westcott QC successfully acted for the Claimant in Harris v Miller [2016] EWHC 2438 (QB). The Claimant was 14 years old when she fell off the Defendant’s horse and sustained paraplegia. An action was originally brought in negligence and under the Animals Act 1971; but since, on the particular facts of the case, the Claimant could not have succeeded in the statutory claim if she failed at common law, only negligence was pursued at trial. The facts were hotly disputed by the parties. The allegations made this morning against Tommy Wright, the Barnsley assistant manager, are the latest in what is likely to be a continuous media release of corrupt activities in football. Whatever one’s views on the investigative and reporting practices of the newspapers whose main concern may be to sell more copy, there is little doubt that the spotlight is being thrown again upon what seems to be an endemic problem in the ‘people’s game.’ Supporters of this great game should welcome this spotlight. Starting on Tuesday 12th April, over 90 hospital patients from each spinal injury centre across the UK and Ireland will participate in the Inter Spinal Unit Games, organised by WheelPower at Stoke Mandeville Stadium. Three Outer Temple Barristers were invited to take part in a wheelchair awareness day, organised by Bolt Burdon Kemp Solicitors, with the able assistance of the Back-Up Trust and the Wheelchair Rugby Experience. Harry Trusted, Eliot Woolf and Ben Bradley spent the morning learning essential wheelchair skills with the Back-Up Trust. They were then sent off into the wilds of Islington in said chairs to (amongst other things) board a bus; buy a coffee; undertake a weekly shop; tackle cobbled streets and find a wheelchair accessible beauty salon. The afternoon was spent playing the brutal sport of wheelchair rugby, run by the inspirational athletes at the Wheelchair Rugby Experience. Instructed by leading litigation firm Stewarts Law LLP, Christopher and Matthew advised and represented Mark Pollock throughout his claim, obtaining judgment following a “difficult” five-day trial before William Davis J. Unbroken by blindness at 22, Mark competed in ultra endurance races across deserts, mountains, and the polar ice caps including an epic two month expedition race to the South Pole. He won silver and bronze rowing in the Commonwealth Games. Describing Mark, the Judge said: “His athletic achievements would have been notable for someone without disability. Given his blindness they were and are remarkable”. The judgment provides much needed security whilst Mark continues his journey, now as a pioneer exploring the frontiers of spinal cord injury recovery.

Kelly Woods, a lifeguard employed by DC Leisure (a swimming pool centre in Wolverhampton) was finally found not guilty on a s.7 HSWA 74 offence at Wolverhampton Crown Court, after a five year battle to clear her name.

Ben Bradley is speaking at this essential one day course for physiotherapists working in this specialist field. The course is aimed at providing an overview of the legal background to the law of medical or clinical negligence and as a risk management exercise for both physio therapists working in professional sport and the club as their employer. It will aim to raise awareness of the possible areas of exposure to risk and provide advice on how this risk can be reduced.
