We are pleased to announce that Outer Temple barrister Ian Denham has been appointed as the new Representative for England and Wales on the PEOPIL General Board. On Thursday 15th September 2022, PEOPIL announced their new General Board members on the eve of the Annual Conference in Copenhagen. Ian succeeds Philip Mead of 12KBW who steps down after completing his time in this role. Ian will continue to represent the interests of PEOPIL members from England & Wales, which has one of the largest memberships by country. The Board is presided over by Spanish lawyer Ana Romero. Ian Denham recently acted for the successful respondent in an appeal concerning the scope of article 4(3) of the Rome II Regulation. The Claimant had been on holiday in France when she was involved in a road traffic accident with an uninsured vehicle. An issue arose as to whether the claim against the motor insurer of the vehicle in which she was travelling was governed by English or French law. Olinga Tahzib considers the recent decision of the Supreme Court in Brownlie (No 2) and asks what next in jurisdiction for tort claims in a post-Brexit England and Wales? In January 2010, Lady Brownlie was on holiday in Egypt staying at the Four Seasons hotel. She booked through the concierge a jeep tour which went tragically wrong when the vehicle in which she, her husband Sir Ian Brownlie, Ian’s daughter Rebecca and her two sons were travelling crashed in the desert. The Supreme Court has this morning dismissed the appeal of the Four Seasons hotel group, meaning that Lady Brownlie’s claims for personal injury and wrongful death arising out of the accident which killed her husband, Sir Ian Brownlie, in Egypt over 10 years ago, can proceed before the courts of England and Wales. The Court held by a majority (Lords Reed, Lloyd-Jones, Briggs and Burrows JJSC), that the jurisdictional gateway in tort claims pursuant to the civil procedure rules applies where a significant part of the damage is or will be sustained in England and Wales, notwithstanding initial or other damage also sustained outside the jurisdiction. On 15 and 16 October 2021, the Annual Conference of the Pan European Organisation of Personal Injury Lawyers was held in Málaga, Spain. This was the first conference held by PEOPIL since the pandemic started. Both Sarah Crowther QC and Ian Denham were invited to speak at the Conference.
