OTC Travel Talks: Limitation in Czech Republic, Denmark & Poland Part 2

In the second part of this discussion Ian and his guests discuss extension of limitation periods and consider:

  • Whether the limitation period be extended by agreement between the parties or by Court order.
  • Whether there is a limit as to how many times limitation may be extended.
  • The means of starting proceedings.
  • What to do if the limitation expires before proceedings are commenced.

In Part 1, Ian and his guests discussed limitation periods, a key issue for cases which run in England but apply foreign law:

  • Does the limitation period vary depending on the cause of the injury?
  • Is the limitation period any different depending who is liable (private citizen, insurer, state body)
  • Does the limitation period vary depending on the cause of action?
  • When the ‘clock starts’ for limitation purposes in different scenarios?
  • Is the duration of a limitation period affected by criminal proceedings involving the same issue or parties?
  • Does the clock start at a different time for children or a person without legal capacity?
