The UAE’s ability to effectively host increasingly complex international dispute resolution proceedings was evident in a recently settled $120 million dispute referred to arbitration in Dubai.
In that case, the Dubai Court of Appeal unequivocally upheld the Dubai seated Arbitral Tribunal’s finding that it was a “competent judicial entity” with the same standing as a competent court to authorise the production of confidential information under the terms of Federal legislation restricting the circulation of such information.
Philip Punwar (Dip. I.C. Arb., C. Arb) of Outer Temple Chambers was lead counsel for the Claimant, whose interpretation of the relevant legislation underpinned the Tribunal’s original decision.
Philip Punwar is an English qualified practitioner with more than twenty-five years’ arbitration experience. His recent arbitral engagements have concerned real-estate Mega Projects in the Gulf, investment treaty claims arising out of the MENA and South Asia regions, aircraft charter agreements, concession agreements in the water sector and technology disputes in the finance and healthcare sectors.
