Setting the discount rate (personal injury awards) – some thoughts

With the lord chancellor finally revealing a new personal injury discount rate after months of deliberations – and which is due to come into effect from 5 August – Sarah Crowther QC and Dan Clarke give their thoughts on the developments, setting them in context. Today’s headlines may focus on which ‘side’ of personal injury claims has ‘won’ or ‘lost’ but, as the authors indicate, the real winner may in fact be fairness. The review system appears to have increased transparency, consultation and evidenced-based decision-making, with a view to trying to ensure that compensation is truly both full and fair to both sides.
