Earlier this week, James Counsell KC and Ben Bradley appeared on behalf of BXB in the Supreme Court in Trustees of the Barry Congregation of Jehovah’s Witnesses v BXB. Having previously won at trial, and subsequently in the Court of Appeal, James and Ben represented BXB at the Supreme Court in her claim that the Trustees of the Barry Congregation of Jehovah’s Witnesses are vicariously liable for a rape committed on her by Mark Sewell, one of the Elders of the Congregation. This case represents the return of vicarious liability to the Supreme Court for the first time since the seminal cases of Barclays Bank and Morrisons. Ben Bradley secures £2.3m settlement for client with brain injury after RTA

Ben Bradley has successfully represented a cyclist in a personal injury claim after he sustained life changing brain injuries in a road traffic accident. Ben’s client, WH, was hit by a lorry whilst cycling to work when the lorry driver accelerated to try and clear a junction before the traffic lights turned red. The light had in fact turned red before the lorry passed through, leading to a collision with WH. WH was knocked unconscious and was taken to hospital. He had sustained skull fractures, a subarachnoid haemorrhage and brain contusions. He also suffered post-traumatic amnesia. Four Claimants, all represented by James Counsell QC and Benjamin Bradley, have settled their claims for damages against Chelsea Football Club for undisclosed six figure sums in abuse proceedings. The Claimants settled their claims for damages against Chelsea Football Club for undisclosed six figure sums on 7th February at a pre-trial review hearing.  The claims, which were listed for a six week trial, involving 62 witnesses, in four weeks’ time alleged that two former employees, Graham Rix, the former England international footballer, and Gwyn Williams, whilst working for the club’s youth training programme in the 1990s, racially abused these four young black footballers when they were aged between 14 and 18. Latest development in ongoing Civil Action against Manchester City FC – Barry Bennell to give evidence

Convicted paedophile Barry Bennell, is to give evidence for the first time, in the ongoing trial against Manchester City FC. James Counsell QC and Ben Bradley continue to act in this ongoing trial for eight victims. On Tuesday 30 November, Manchester City FC will open its case, relying on evidence from the perpetrator himself, Barry Bennell. Bennell is serving a 34-year prison sentence for around 90 separate sexual offences perpetrated against children. Bennell is likely to say that he played no part in Manchester City FC’s youth operations. James Counsell QC and Ben Bradley represent eight victims in the High Court, seeking damages from Manchester City FC after suffering sexual abuse from one of the country’s most prolific sex offenders. James and Ben represent eight claimants who were subjected to sexual abuse by Barry Bennell whilst they were playing for Manchester City FC junior or ‘feeder teams’. These teams were set up by the Defendant, Manchester City FC, for the purpose of seeking to recruit a steady source of highly talented young footballers who were then of an age (under 14) when they could not be formally signed up to schoolboy contracts.  James told the Court that Barry Bennell was recruited by the Defendant to scout promising young…
