Sajid Suleman successful in landmark DIFC Court of Appeal anti-suit injunction case

Sajid Suleman appeared in the DIFC Court of Appeal for the successful Appellants in the landmark anti-suit injunction dispute in Nashrah v Najem (1) and Nex (2) – ARB 005/2025. The case involved a complex jurisdictional dispute concerning an anti-suit injunction granted by the DIFC Court of First Instance, which halted proceedings in the English High Court. The English proceedings included an expedited application for a stay under section 9 of the Arbitration Act 1996, and a hearing for an anti-arbitration injunction – scheduled to take place the day after the DIFC anti-suit injunction was obtained. Oliver Lawrence defeats non-compete injunction in the High Court

Oliver Lawrence successfully represented the Defendant before HHJ Watson (sitting as a High Court Judge) in Birmingham. The application for a non-compete injunction was brought by a catering company against one of its former managers. The injunction sought would have prevented the employee from working for a competitor for six months after the termination of his employment. The main issue in the case was whether the non-compete covenant was drafted too broadly to be enforceable. It was found to be too wide. The contractual wording was insufficient to tie the prohibited activities to the sector of the former employee. The absence of a geographical restriction meant that the non-compete operated globally. Can an applicant still apply for Freezing and Proprietary Injunctions remotely? During these uncertain times during the lockdown, the question arises as to whether an applicant may still apply for an urgent interim without notice freezing or proprietary injunction as well as ancillary orders, such as a search order or a Norwich Pharmacal/Banker’s Trust order, (which will be collectively referred to as an “injunction” or “injunctive relief”) at the High Court?
