Will was instructed by the Claimant in a clinical negligence claim alleging negligent failure on the part of an NHS Trust to diagnose bowel obstruction, leading to a bowel perforation, and subsequent post-ITU syndrome. The Claimant was a successful businessman, and the claim involved a complex loss of earnings claim, requiring the input of expert Forensic Accountants, and was pleaded just short of £2 million.
Attempts to resolve the claim at a joint settlement meeting with the Defendant were unsuccessful, and the case was listed for a 7 day trial in the High Court. The day before the trial, however, the Defendant made further offers of settlement, and the claim settled for a seven-figure sum, hence avoiding the need for trial.
