Our members have extensive experience in disputes arising from substantial construction, infrastructure, and development projects, acting across the board for developers, contractors, and sub-contractors, including in disputes involving state entities and joint ventures. These disputes are very complex, involving multiple technical (delay, disruption, etc) and quantum experts.

The team has considerable experience in matters concerning professional negligence, insolvency, health and safety, joint venture and shareholder disputes affecting development, pre-action negotiations, delay, disruption, aborted projects, failed infrastructure, defective design, frustration, force majeure, variations, extensions of time and prolongation claims, purchase price, workmanship, defective works, and claims involving liquidated damages.

Team members often act in substantial disputes and projects within the energy sector for oil & gas and mining companies, including pipelines and energy plants. These often arise from investment contracts, joint ventures, tripartite, sale and purchase and oil exploration agreements, performance guarantees, royalties and pricing, guarantees for offtake contracts for natural gas, issues of international jurisdiction and state immunity, assignment clauses, breach, sanctions, fraud, and BIT proceedings.

Chambers work spans litigation, arbitration, adjudication, and mediation, often including public international law and international trade issues. We regularly work with international clients in the UK and throughout Europe, Middle-East, Asia-Pacific, the US, Latin America and the Caribbean under ICSID, PCA, LCIA, ICC, DIFC-LCIA, HKIAC, SIAC, DIAC, ADCCAC, LMAA, UNCITRAL, AAA-ICDR, CAS and ad hoc rules.

As well as our members familiarity with the major institutional arbitral rules, we have experience with standard form JCT, FIDIC, and NEC3 contracts, as well as bespoke agreements, turnkey agreements and claims brought under BIT agreements.

Construction, Energy and Natural Resources Experience

  • Representing a joint venture contactor in a suite of ICC arbitrations arising from the construction of one of the largest infrastructure projects (rail) in the world.
  • Representing the main contractor in respect of $200m+ arbitration claims, including complex delay and disruption elements, against both the employer and subcontractors, in respect of a major greenfield project.
  • Acting for a property developer in a $100m arbitration, arising from the master developer’s failure to construct infrastructure in a high-profile master development.
  • Negotiating service provider agreements on master and building owner levels with service providers for electricity, water, and district cooling.
  • Drafting and negotiating an agreement with a sub-developer regarding a mixed-use development project involving a complex offshore corporate structure for purchase and land acquisition.
  • Drafting sale and purchase agreements relating to land, apartment units, office space and luxury villa units and providing master community development agreement and owners’ association documentation.
  • Drafting mall retail lease agreements and agreements to lease and construction and fit-out agreements, and agreements relating to development, including end-user sale and purchase agreement, and bulk purchase agreements.
