Our Banking & Finance Team has a wealth of experience acting for and against banks and other financial institutions in complex, often cross-border, disputes. Our case-load is varied and encompasses small to medium-sized disputes as well as high profile, big-ticket financial services litigation.

Our members also have expertise in a wide range of non-contentious matters, ranging from advising on security agreements to drafting litigation funding agreements and associated insurance policies.

We are recognised for our expertise in cutting edge areas, such as LIBOR transition and FinTech.

Our Banking & Finance Team are regularly instructed on complex cross-disciplinary cases due to their expertise in not only banking and finance, but also commercial and chancery law more broadly including civil fraud, insolvency and pensions and digital assets.

Banking & Finance Experience

Our Banking & Finance Team have undertaken a number of significant cases and instructions, such as:

  • A claim against a major investment bank concerning the mis-selling of complex FX derivatives
  • A dispute involving a suite of complex lending and security agreements, in a cross-border and insolvency context
  • FX front-running claims
  • Disputes involving the recovery of debts and assets by banks or other lenders arising out of non-performing loans
  • Claims arising out of the enforcement of security, guarantee obligations, letters of credit, guarantees, performance bonds, collective facilities, derivatives and swaps transactions and other leveraged investments
  • Claims arising from mistaken payments procured by third-party frauds and in actions where the bank itself is the fraudulent party or failed to prevent the fraud
  • Disputes concerning the determination of break costs in loan agreements
