Michael Bowes QC – welcome speech on behalf of co-editors at GIR Practitioner’s Guide launch party

GIR celebrated the third edition of The Practitioner’s Guide to Global Investigations with a launch party at the British Library on 23 January.

The publication has grown immensely since it was first launched in 2016 and currently comprises two volumes, edited by Judith Seddon at Ropes & Gray, Eleanor Davison at Fountain Court Chambers, Luke Tolaini and Christoper Morvillo at Clifford Chance, and Michael Bowes QC at Outer Temple Chambers, as well as by two new editors: Tara McGrath at Clifford Chance and Ama Adams at Ropes & Gray.

Volume I of the new edition details every phase of a serious corporate investigation from the UK and US perspectives, while Volume II presents detailed comparable surveys of the relevant law and practice in 21 jurisdictions, now including Australia, Canada, and Mexico, using a standard template.

Other new features of the publication include a substantive chapter on UK and US data protection rules – including the effect of the GDPR – as well as coverage of the first French “DPAs” and of R (on the application of AL) v SFO, a case in which an unnamed individual sought access to records of internal investigation interviews conducted by their former employer.

Previous chapters have been fully revised in light of the English Court of Appeal’s September 2018 ruling in Director of the Serious Fraud Office v Eurasian Natural Resources Corporation. The book also reflects the US Department of Justice’s view of the FCPA Corporate Enforcement Policy and its application.

The book now also includes a complete table of cases, as well as a full index and table of legislation. Chapters are fully cross-referenced with margin notes.

The guide is available online and in hard copy to GIR subscribers. Additional copies can be purchased in the Global Investigations Review bookshop. The guide will be updated annually, and updates will be posted on the GIR website throughout the year.
