Success for the claimants on the central questions of diagnosis and quantification of Military Noise Induced Hearing Loss claims Harry Steinberg KC, Aliyah Akram, and Elliott Courcha of Outer Temple Chambers acted in the landmark military deafness litigation, instructed by Simon Ellis of Hugh James, against the MoD. The High Court has today handed down judgment in the Hugh James Military Deafness Litigation. The decision of Garnham J is a decisive victory for the claimant group. The Court rejected the long-standing CLB and LCB methods and preferred the claimants’ case that military NIHL should be diagnosed and quantified by the rM-NIHL developed by Professor Moore and others. Robert Dickason represents the Secretary of State for Health and Social Care in successfully striking out claims arising from the Government’s hospital discharge policy during the first wave of the Covid-19 pandemic. In this litigation, claims were brought on behalf of care home residents who were alleged to have contracted Covid-19 as a result of the Government’s hospital discharge policy in place in late March and early April 2020. It was alleged that this led to the seeding of Covid-19 within care homes by discharged patients who were infectious but asymptomatic. James Counsell KC and Olinga Tahzib secured in excess of £700,000 gross for a former Private in the British Army at a settlement meeting on 23 October 2025. The Claimant’s claim was part of a group claim against the Ministry of Defence involving individuals who have suffered cold injuries in the course of their service. The Claimant had sustained a non-freezing cold injury to his feet when he was exposed to cold conditions during his military training in the early 2000s. Amongst other things, the Claimant had been required to dig trenches in freezing conditions and to wade through icy cold rivers without appropriate equipment. James Counsell KC has secured £900,000 for a former Royal Navy chef at a settlement meeting on 5 September 2025. The settlement is believed to be to be one of the largest ever for this kind of injury. The Claimant’s naval service had been cut short after she suffered a condition known as ‘non-freezing cold injuries’, affecting both hands and feet as a result of exposure to extremely cold conditions on an exercise in Norway in 2019. She later had to be medically discharged due to injuries, some of which remain with her and are permanent. Ian Denham represented South East Coast Ambulance Service NHS Foundation Trust in the inquest into the death of Azroy Dawes-Clarke. Azroy was a serving prisoner at HMP Elmley at the time of his death on 10 November 2021. He died after tying a ligature around his neck and subsequently being restrained by prison officers. The Interested Persons in the inquest included mental health staff employed by Oxleas NHS Foundation Trust, healthcare staff employed by an independent agency, GPs, paramedics and prison staff.
