Gerard McDermott KC and Will Young were instructed by Ben Townsend and Lucy Mills of Stewarts in a case where the client, JF, was seriously injured in a road traffic collision while cycling to work in 2018.
JF was knocked off his bicycle by a stolen vehicle which was driving on the wrong side of the road. He underwent several surgical procedures after sustaining an enormously complex set of injuries, resulting in JF needing 24-hour care for the rest of his life. As JF did not have the capacity to manage the case himself, his sister and litigation friend issued a claim against the defendant driver and the vehicle’s insurer.
A settlement of record periodical payments was approved by court on 15 March 2024. JF will receive a lump sum of £6 million, to include the interim payments he has already received, and an annual periodical payment of £1.1 million. The settlement figure exceeds £30m, the largest periodical payment figure agreed in England and Wales. The funds will allow JF to have two 24 hour carers for the rest of his life, including a trained nurse.
