Helen Pugh has been shortlisted in the Citywealth Powerwomen Awards 2025- International, for Woman of the Year in FinTech/ Crypto. The Citywealth Powerwomen awards spotlight individuals and companies who support caregiving responsibilities, female leadership, and celebrate diversity. Andrew Spink KC and Justina Stewart have succeeded in securing a re-trial in (1) Gate Mena DMCC (2) Huobi Mena FZC v Tabarak Investment Capital Ltd and another DIFC CA-002-2023 (‘Huobi v Tabarak’). In a much anticipated judgment, the DIFC Court of Appeal (Justice Black KC giving the leading judgment) has reviewed the law in relation to digital assets, and developed DIFC jurisprudence in other areas. The DIFC recently enacted wide-reaching legislative reform, in the form of the DIFC Digital Assets Law and Law of Security and associated amendments to numerous DIFC laws (a project on which Andrew and Justina, alongside other OTC members, were instructed). Outer Temple Chambers’ digital assets, and banking and finance experts advised the DIFCA on innovative new laws on Digital Assets and secured transactions in September 2023, which have now been enacted. The new Digital Assets Law is considered to be ground-breaking as it is the first legislative enactment to comprehensively set out the legal characteristics of digital assets as a matter of property law, to provide for how digital assets may be controlled, transferred and dealt with by interested parties and to introduce an impairment regime that addresses the unique characteristics of digital assets. The new Law of Security is influenced by the UNCITRAL Model of Secured Transactions and significantly enhances DIFC’s securities regime to keep pace with international developments…

Andrew Spink KC and Justina Stewart appeared in the DIFC Court of Appeal on behalf of the appellant in Huobi MENA & Anor v. Tabarak Investment Capital Limited & Anor, in what promises to shape the landscape of digital assets disputes. The claim, worth multi millions of dollars, concerns alleged custody and escrow services provided by Tabarak, a DFSA-regulated investment bank, in relation to a bitcoin to US$ transaction and misappropriation. Following an eight day trial in late 2021 in the DIFC Court, Andrew and Justina’s clients obtained permission to appeal on all eight grounds of appeal.
