James Counsell KC and Fiona Horlick KC are due to be speaking at the ARDL 2nd Annual Conference 2022. This will be taking place on 30th September 2022 at the Museum of London. Fiona Horlick QC secures acquittal in manslaughter case against her anaesthetist client

Fiona Horlick QC represented one of one consultant anaesthetists accused of gross negligence manslaughter following the death of a patient after an operation at Nobles Hospital on the Isle of Man. The case was dismissed. Fiona’s client, Dr Katherine Teare, had responded to an emergency alarm and assisted trying to revive a patient after he suffered a cardiac arrest in theatre. The prosecution case was that another anaesthetist, who had been the anaesthetist for the operation, had tried to wake the patient up after the operation, had removed the endotracheal tube and then had to reinsert it when the patient was struggling to breath and in doing so allegedly wrongly placed it in the oesophagus instead of the trachea depriving the patient…

Fiona Horlick QC secures acquittal in NHS bribery trial

Fiona Horlick QC has secured an acquittal of her pharmacist client in a bribery trial which concluded last week at Southampton Crown Court. Fiona’s client, a pharmacist, was accused together with two other pharmacists and a doctor, of bribery on behalf of pharmaceutical companies in order to secure the prescribing of medications on the NHS. All four defendants maintained their innocence.  The trial followed a 6 year investigation with the need to scrutinise hundreds of thousands of documents and communications dating back around 20 years. However, serious disclosure failures on behalf of the investigation team were uncovered in large part by Fiona’s team and the prosecution offered no further evidence after 6 weeks of trial. Fiona Horlick QC secures acquittal of 11 counts of sexual assault and 1 count of indecent assault

Consultant Physician defended by Fiona Horlick QC was acquitted of all charges following a 4 week trial at Cardiff Crown Court. Dr Krishna was charged with 11 counts of sexual assault and 1 count of indecent assault between 1996 and 2017 in relation to 7 separate women, 5 of whom were his patients and 2 other women who were his colleagues.  Having heard 4 weeks of evidence including expert evidence, Dr Krishna was unanimously acquitted by the jury. Dr Krishna who has serious health conditions was permitted to attend the trial remotely. Double Success in GMC Appeal for James Counsell QC

In a judgment handed down by Warby J on 22 July, James Counsell QC was successful in an appeal and in a judicial review against the GMC in disciplinary proceedings brought against a cosmetic surgeon, Dr Ashish Dutta, arising out of allegations which went back to 2009. The judgment in R (on the application of Dr Ashish Dutta) v the General Medical Council [2020] EWHC 1974 (Admin) can be found here. Fiona Horlick QC defends professional body against costs application

Fiona Horlick QC recently appeared for a professional body in a Disciplinary Tribunal Panel Hearing, defending an application for costs made by the Respondent. The application was unique as the Panel had to consider whether it could, and if so, should award costs to a non party – the employer of the Respondent. Prior to the costs application, the Respondent had been charged with misconduct and the Respondent’s employer instructed a magic circle firm of solicitors. However, as new evidence had been received such that the professional body’s case was weakened, the professional body sought that the charge be dismissed by the Panel prior to it being heard at a Tribunal hearing.
