Outer Temple invites you to join us at Dubai Arbitration Week

Outer Temple Chambers’ International Arbitration experts, alongside other esteemed speakers will be hosting a talk on ‘Arbitration in banking and financial services disputes’ on Monday 13th November at The Ritz-Carlton, Dubai.

Outer Temple Chambers is delighted to join our esteemed guests from Allen & Overy, Ernst & Young and Clyde & Co for a discussion on arbitration in the context of banking and financial services disputes.

Outer Temple’s Andrew Spink KC, Justina Stewart and Lucian Ilie will be hosting a talk at Dubai Arbitration Week on Monday 13th November 2023 alongside William Prasifka of Clyde & Co, Arash Koozehkanani of Allen & Overy, and Matt Fritzsche of Ernst & Young on the topic of ‘Arbitration in banking and financial services disputes’.

In the context of the growing use of arbitration in banking and financial services disputes, our panel of experts will discuss:

  • tailoring arbitration clauses and the arbitrations themselves to these specialist disputes;
  • factors specific to the MENA region;
  • investment treaty arbitrations; and
  • the presentation of evidence.

Speaker Bios

David Russell KC, Barrister, Outer Temple Chambers

David Russell KC commenced legal practice in 1974. He is admitted to practise in Australia, England and Wales (Lincoln’s Inn), the Courts of the Dubai International Financial Centre, New York (as a Legal Consultant), New Zealand and Papua New Guinea.

He currently practises in Dubai, London, and Abu Dhabi (Outer Temple Chambers), Sydney (Ground Floor Wentworth Chambers) and Brisbane (Sir Harry Gibbs Chambers). He has acted for Commonwealth and State Governments as well as individuals and corporations. David was President of the Taxation Institute of Australia from 1993 to 1995, and of the Asia Oceania Tax Consultants’ Association from 1996 to 2000.

Andrew Spink KC, Barrister, Outer Temple Chambers

Andrew Spink KC is a highly respected advocate with 38 years’ experience at the Bar, of which 20 years have been as a successful KC.

Andrew has a broad-based business law practice, specialising particularly in disputes relating to the interpretation or breach of most types of commercial contract and trust deed, claims for breach of fiduciary duty, freezing injunctions and asset recovery, cross-jurisdictional issues, CPR Part 8 claims as well as hostile CPR Part 7 claims for damages and other relief in the context of pensions and other commercial trusts, banking and financial services, a wide range of other commercial contracts and contractual issues (including cases of force majeure and frustration arising out of the Covid-19 pandemic and cases involving crypto-assets and associated worldwide freezing orders), professional negligence claims (acting for both claimants and defendants) and company law and insolvency issues.

Sean Yates, Barrister, Outer Temple Chambers

Based in Dubai, UAE, Sean specialises in international arbitration and civil and commercial litigation with a focus on construction and infrastructure, real estate, energy and natural resource disputes. More widely, Sean has experience in employment, fraud and regulatory, as well as substantial experience in the tourism, leisure and entertainment sectors.

Sean is a member of Inner Temple and practised before the courts of England and Wales for ten years before relocating to Dubai. He acted as General Counsel for several years before returning to practise in Chambers.

He has experience in both common law and civil law disciplines and can advise on both international and local law matters in the UAE.

Justina Stewart, Barrister, Outer Temple Chambers

Justina Stewart’s practice encompasses the full range of commercial litigation, with a particular emphasis on banking and financial servicescivil fraudfintech and digital assets, insolvency and international arbitration.

She is ranked in the key legal directories as a Leading Junior in several areas: Commercial Litigation/Commercial Dispute Resolution, Banking and Finance, Fintech and digital assets, Financial Services Regulation; and Insolvency.

Justina is ranked as a Leading Junior in Chambers UK Bar, Chambers Global, Legal 500 and Legal 500 Middle East.

Shabana Saleem, Barrister, Outer Temple Chambers

Shabana is a member of our International Team specialising in private wealth. She spent a number of years in-house at leading legal 500 UK law firms and relocated to Dubai to focus on her Middle East based practice.

Shabana specialises in working with UHNW individuals to address private client matters, with a particular understanding of contentious family matters and the English law treatment of Islamic marriages.

She has advised trusts, family businesses and UHNW clients on wealth protection matters. She advises on contentious and non-contentious wealth management matters.

Lucian Ilie, Barrister, Outer Temple Chambers

Lucian is a barrister specialising in international law, transnational litigation and international arbitration, with particular expertise in investor-State disputes and commercial arbitration cases. Combining experience of civil law culture with common law know-how, Lucian’s practice areas include: (i) International Arbitration (including arbitration-related litigation), (ii) International Organisations, (iii) Private and Public International Law (including rules of jurisdiction, conflict of laws, enforcement of foreign judgments/awards, State immunity, extradition, ECHR law) and (iv) International Commercial Litigation (including before the DIFC and ADGM courts).

William Prasifka, Barrister, Clyde & Co 

William is a barrister with over eight years’ experience. His practice focuses on arbitration as well as litigation before the DIFC and ADGM Courts. He has represented major financial institutions, media and technology companies and firms involved in all aspects of the construction industry. William acts as an advocate in complex international arbitrations, freezing injunctions and a variety of commercial disputes.  

Before relocating to Dubai, William practiced law as a barrister in Dublin. He regularly appeared before the High Court and Court of Appeal with a specialisation in cases involving the financial sector.

William holds a degree in history from Columbia University and a law degree from the University of Cambridge.

Arash Koozehkanani, Senior Associate, Allen & Overy 

Arash is Senior Associate in the Litigation and International Arbitration practice of Allen & Overy (Dubai).

He has extensive experience advising and acting on complex and high-value commercial litigation and international arbitration proceedings.

Matt Fritzsche, Partner, Ernst & Young 

Matt specialises in acting as expert witness in litigation and international arbitration. He leads multi-disciplinary teams across EY’s global network to advise on economic, financial, valuation and industry-specific issues.

Matt also helps to resolve disputes outside of formal proceedings through negotiation and expert determination, particularly those arising from sale and purchase agreements.
