Helen and Paul Rea from Ipswich have today received court approval for a financial settlement which will ensure that their son Joseph, who has cerebral palsy, can be given the appropriate care and support that he will need for the rest of his life.

Ben Compton QC secures acquittal in the latest legionella prosecution

After a 3 year battle, the HSE finally offered no evidence against Balticare Ltd, the sister company of Balticare Aircoil Ltd (a manufacturer of cooling towers in the USA), at Shrewsbury Crown Court. The HSE, had been alleging design faults on the FXV and CXV Evaporative Condensers installed in the UK from the late 1990’s and despite the fact that there had never been any outbreak of legionella and against a background of substantial co-operation by Balticare, decided to charge the company with breaching Section 6(1) of the Health and Safety at Work Act 1974. Oliver Assersohn gives talks about current issues in Financial Services disputes at seminars in Shanghai and Beijing

Oliver was part of the Bar Council delegation visiting Seoul, Shanghai and Beijing this month which was led by the Chair of the Bar and the Head of the Bar’s International Committee. Oliver’s talk at the two seminars emphasised the benefits of mutual exchange of information given the increasing interaction between China and the City of London and the imminent launch of the free trade zone in Shanghai. Oliver addressed issues of jurisdiction, regulatory trends and some key developments in the commercial courts five years on from the collapse of Lehman Brothers.

Richard Lissack QC and Nicholas Hill successfully defend international property management company

Richard Lissack QC and Nicholas Hill successfully defend an international property management company (with over 1,100 sites in the UK) against a prosecution brought by the London Borough of Havering. The case, listed across two weeks at Snaresbrook Crown Court, concluded after two days following cross-examination of the Prosecution’s expert Consultant Engineer, the Prosecution accepting that they no longer had a realistic prospect of securing a conviction. The case was based on an alleged breach of s4 of the Health & Safety at Work etc Act 1974 following serious injury to a 12 year old boy resulting from his deliberate misuse of a flying escalator installation. Stephen Climie and Ben Bradley achieve substantial CICA award for Australian national

Two members of Chambers (instructed by Rebecca Dixon of Stewarts Law LLP) have recently been involved in assisting an Australian national to obtain a significant award before the First-Tier Tribunal (Criminal Injuries Compensation). The Appellant was injured in an unprovoked attack in London in 2004, which caused the client to suffer a brain injury. The CICA had initially contended that the Appellant was not entitled to any form of award at all by reason of his alleged conduct prior to the incident. Stephen Climie represented the Appellant at the eligibility hearing. Judge approves man’s sterilisation

John McKendrick, instructed by Weightmans solicitors, has appeared for the local authority in a ground breaking case before the Court of Protection. Today, Mrs Justice Eleanor King has made legal history by granting an application for a declaration that it is lawful and in the best interests of an incapacitated adult to undergo a non therapeutic sterilisation. This is believed to be the first time a court in this jurisdiction has approved such a procedure being carried out on a man who is incapable of consenting.
