The Upper Tribunal today published a decision giving reasons for refusing the Authority’s application for a “split trial” of the conjoined references of Stewart Ford (the former CEO), Mark Owen (the former FD) and Peter Johnson (the former compliance officer) arising out of the failure of Keydata Investment Services Limited (“Keydata”). Keydata was involved with certain investment products underpinned by bonds issued by two special purpose vehicles incorporated in Luxembourg, SLS Capital SA and Lifemark SA (“Lifemark”). The Luxembourg regulator (the CSSF) closed Lifemark to new business in mid-2009, and it was put into liquidation on 11 May 2012. Keydata ceased trading in June 2009 and went into administration. James Leonard, led by Ian Stern QC (2 Bedford Row), represented Dr Errol Cornish in a landmark corporate manslaughter case, against an anaesthetist and NHS trust. The trial collapsed in the third week of the hearing at Inner London Crown Court. The Jury were instructed by Mr Justice Coulson, to acquit both defendants on Thursday, having ruled the day before that they had no case to answer. It was the first time a health service body had been prosecuted, following the introduction of the offence. There will be no appeal. Matthew McDonagh successfully secured the acquittal of Vincent Walsh, a former senior equities trader at RBS. Mr Walsh had been charged with an alleged conspiracy to cheat the Inland Revenue amounting to millions of pounds of tax relief generated by investment in the British Film Industry. He was acquitted following an eight-week trial that concluded just before Christmas last year. Other defendants in the case who were convicted have now received substantial sentences following their involvement in the conspiracy. Miranda de Savorgnani recently gave an interview to LexisPSL on a recent European Court of Justice case, ruling under the Brussels I Regulation, Aannemingsbedrijf Aertssen NV & Another Company v VSB Machineverhuur BV & Others: C-523/14 [2015] All ER (D). The case clarifies that ancillary civil matters brought in the context of criminal proceedings qualify as civil proceedings in their own right under Brussels I and Brussels I (recast). The amendments to Brussels I will assist the determination of the time when a court is first seised, by requiring greater cooperation between courts.

Politicians and corrupt police officers were accused yesterday of covering-up the systematic child sex abuse by paedophiles on Jersey. Patrick Sadd, Counsel to the Inquiry, questioned Lenny Harper, retired Deputy Chief Officer of States of Jersey Police, who told the official inquiry that yachtsmen were “loaned” vulnerable children to abuse.
