MOJ Publishes Review of Criminal Injuries Compensation Scheme

Carin Hunt outlines the MOJ’s proposed reforms to the Criminal Injuries Compensation Scheme. The proposals seek to better support victims of violent crime, particularly those who suffer historic or current child abuse. The Criminal Injuries Compensation Scheme (“the Scheme”) is a statutory scheme that compensates victims of violent crime in England, Scotland and Wales. On 16 July 2020, the MOJ published its first review of the Scheme since 2012, setting out a number of proposals for reform (“the Review”). The Scheme The Scheme is a tariff-based system for determining injury awards for victims of violent crime. Carin Hunt reviews the new procedural requirements for foreign language witness statements following the 113th update to the CPR Practice Directions. Try not to get too excited, but a number of updates to the Practice Direction to Part 32 (Evidence) of the CPR came into force on 6 April 2020 – and I’m going to tell you about them. Specifically, this article will update you on the changes to the procedural requirements for foreign language witness statements, which are relevant to those of us litigating cross-border disputes. Special Accommodation Damages – Where Next?

Carin Hunt published in the Journal of Personal Injury Law. An article by Carin Hunt titled ‘The Cost of Special Accommodation’ has been published in the Journal of Personal Injury Law in June 2020 (J.P.I. Law 2020, 2, 127-134). In her article, Carin discusses the shortcomings of the method for calculating the special accommodation damages payable in serious personal injury claims, which was formulated in Roberts v Johnstone (CA), and which produces a negative figure when a negative discount rate applies. Carin reviews the justification for the formula, its practical application and the scope of the problems it presents. She then presents an alternative starting point for calculating such awards, based on the property’s rental value, and notes mitigation issues.…

Coroners and COVID-19 – the guidance and the process

The Chief Coroner has recently published a series of guidance notes to advise coroners on dealing with COVID-19 related deaths. Carin Hunt summarises the advice and the process to be followed by medical practitioners where a death has been caused by this coronavirus. On 26 March 2020, the Chief Coroner published guidance (no 34) for all coroners in England and Wales on the approach to be taken to COVID-19. This was followed on 27 March 2020 by guidance (no 35) which deals specifically with hearings during COVID-19. High Court rules on the Personal Liability of a Director and Company Secretary

Andrew Allen recently appeared in the High Court, leading Mark Greaves, on behalf of the First, Second and Third Defendants in Antuzis & Others v DJ Houghton Catching Services Ltd & Others [2019] EWHC 843 (QB), in proceedings concerning an application for summary judgment and trial of a preliminary issue. Judgment for the Claimants was handed down on 8 April 2019, when the Defendants were represented by Carin Hunt of Outer Temple Chambers.
