High Court hands down judgment in landmark case concerning amendment powers

The High Court has handed down its judgment in British Broadcasting Association v (1) BBC Pension Trust Limited (2) Christina Burns in which Andrew Spink KC and Saul Margo, instructed by Helena Berman at Stephenson Harwood acted on behalf of the successful Representative Beneficiary. This landmark decision is now only the second case (after Lloyds Bank Pension Trust Corporation v Lloyds Bank plc [1996] PLR 263) in which a domestic court has found that a fetter on a pension scheme’s amendment power protects future service benefits. The case was brought because the BBC wished to limit the ongoing costs of funding the BBC Pension Scheme and needed to understand the scope of the fetter on the Scheme’s amendment power. The…

Andrew Short KC and Saul Margo successful in Sainsbury’s Supermarkets Ltd v Clark

The Court of Appeal has handed down judgment in Sainsbury’s Supermarkets Ltd v Clark and Others in which the successful claimants were represented by Andrew Short KC and Saul Margo. In this long-running equal pay claim against Sainsbury’s Supermarket, a number of the claimants brought their claims on a claim form that only contained one EC number relating to one of the claimants on the form. The claims were rejected on that basis, but the claimants successfully appealed to the EAT where it was held that it is sufficient if one EC number is given on the claim form for any claimant who brings a claim on the same form. Members of Outer Temple appointed to appointed to the Attorney General’s London Panels

Chambers is pleased to announce that the Attorney General has appointed Saul Margo to the London A Panel and Chloë Bell to the London C Panel of Junior Counsel to the Crown. The Panel of Junior Counsel to the Crown consists of junior counsel who undertake civil work for all government departments. Members of the A panel deal with the most complex government cases in all courts and tribunals, including the Supreme Court. They will often appear against Queen’s Counsel. Saul Margo presents an Employment Law Webinar on Vicarious Liability.  As part of the 28 barristers – 14 day Employment Law Series, Saul Margo presents a Q&A Webinar on Vicarious Liability. Saul recently presented this webinar in a series of employment law seminars put together by Outer Temple’s Daniel Barnett. In this Webinar Saul provided an overview of the law of vicarious liability with a particular focus on the two recent Supreme Court cases (Morrisons and Barclays) and the differences between the common law test and the test applicable to discrimination claims in the ET. Williams v The Trustees of Swansea University Pension & Assurance Scheme & Another [2018] UKSC 65

Keith Bryant QC and Saul Margo successfully represented the Trustees of Swansea University Pension and Assurance Scheme and another before the Supreme Court. Facts The case was about the interpretation of ‘treats…unfavourably’ under s.15(1) of the Equality Act 2010 (‘EA 2010’) which reads as follows: ‘A person (A) discriminates against a disabled person (B) if – (a) A treats B unfavourably because of something arising in consequence of B’s disability, and (b) A cannot show that the treatment is a proportionate means of achieving a legitimate aim’ (emphasis added). Mr Williams was ‘disabled’ within the meaning of s.6 EA 2010. He was employed by Swansea University from 12 June 2000 until he retired for ill-health reasons on 30 June 2013, aged 38.…

Court of Appeal guidance on time limits for lodging appeals in the Employment Appeal Tribunal

Limitation period for lodging appeals: Two members of Outer Temple Chambers, Saul Margo and Will Young, acted recently for the successful Appellants in joined appeals in the Court of Appeal. These joined cases contain new guidance regarding extensions of time for lodging appeals to the Employment Appeal Tribunal. In both cases (Bonnie v DWP and Rana v LB Ealing), the Appellants had their claims dismissed in the ET and sought to appeal to the EAT. Similarly, in both instances the ET sent the judgment/reasons to the Appellants’ previous legal representatives, who had in fact come off the record and ceased acting for them.
