Louis Weston acts for the British Horseracing Authority in high profile disciplinary case

Louis Weston acts for the BHA in the disciplinary case against Robbie Dunne relating to alleged bullying and harassment of Bryony Frost. Robbie Dunne appeared in front of a British Horse Racing panel on Tuesday 30th November 2021 to face allegations of acting in a violent or improper manner towards Britain’s most successful female rider, Bryony Frost, and acting in a way prejudicial to the sport. Robbie is charged with abusing, harassing and intimidating Bryony. The disciplinary panel has heard from Louis Weston that Robbie threatened to cause fellow ride Bryony serious physical harm and using “foul, sexually abusive and misogynistic language”. Latest development in ongoing Civil Action against Manchester City FC – Barry Bennell to give evidence

Convicted paedophile Barry Bennell, is to give evidence for the first time, in the ongoing trial against Manchester City FC. James Counsell QC and Ben Bradley continue to act in this ongoing trial for eight victims. On Tuesday 30 November, Manchester City FC will open its case, relying on evidence from the perpetrator himself, Barry Bennell. Bennell is serving a 34-year prison sentence for around 90 separate sexual offences perpetrated against children. Bennell is likely to say that he played no part in Manchester City FC’s youth operations. Oliver Powell joins panel discussion concerning Investigations and Enforcement Action in the Financial Services Sector

Oliver Powell was invited to sit on a panel discussion hosted by Brodies LLP which discussed the Financial Conduct Authority’s criminal investigatory and enforcement powers. Other panellists included: Paul Marshall, Partner Brodies LLP; James Millwards, Senior Associate Brodies LLP; and Lisa Kinroy, Associate Brodies LLP. The session was well attended by a large number of FCA-regulated professionals and businesses. Alex Haines successful against IMO’s Applications for Interpretation of Judgment before the UN Appeals Tribunal, New York

The United Nations Appeals Tribunal (UNAT) has dismissed as “misplaced” the International Maritime Organisation (IMO) Secretary-General’s July 2021 applications for interpretation of the landmark 2019 UNAT judgments on the IMO’s international justice system in which Alex Haines, assisted by Stephen Butler, was instructed by the successful claimants. On Friday 19th November 2021, the UNAT in New York – sitting as a full bench (i.e., all seven judges) – released its 29th October 2021 Judgment No. 2021-UNAT-1148 in the case of Fogarty, Sheffer, Spinardi, Dispert and Hoe (Respondents) v Secretary-General of the IMO (Applicant) (the “2021 Judgment”). John McKendrick QC appears in Supreme Court in JB v A Local Authority

John McKendrick QC, leading Ian Brownhill and Helen Laws, and instructed by Karen Jackson at Enable Law, appeared in the landmark decision of JB v A Local Authority [2021] UKSC 52 – the first time the Supreme Court has considered issues of capacity under the Mental Capacity Act 2005.  Acting for JB’s litigation friend, the Official Solicitor, John appealed the decision of the Court of Appeal that JB was required to understand that his potential sexual partners must consent to have sexual relations with him.  The Supreme Court noted the appeal ‘raises issues of profound significance’ but went on to reject the grounds of appeal advanced. Paul Livingston is Junior Counsel to the Brook House public inquiry, set up to investigate mistreatment of individuals detained at Brook House IRC in 2017, as shown on BBC Panorama’s “Under-Cover: Britain’s Immigration Secrets”. ACCA v Awodola

Joshua Hitchens successful in the Court of Appeal against ACCA

The Court of Appeal this week handed down judgment in Association of Chartered Certified Accountants v Awodola. Acting on behalf of the Respondent was Joshua Hitchens. The Background Mr Awodola had sought to appeal a decision striking him off as an accountant.  The Association refused his appeal and wrote to him in November 2018 informing of his right to apply for reconsideration of the refusal and for such an application to be considered at an oral hearing. On 01 January 2019, the Association changed its Regulations abolishing the right to an oral reconsideration hearing. On 02 January 2019, Mr Awodola filed his application for an oral hearing supported by written reasons within the 28-day time limit referenced in the November letter.…

Damien is a former solicitor in Australia (2001), England and Wales (2008) and Hong Kong (2016) before transferring to the bar in Hong Kong (2020), and UK Bar (2021). He was a registered foreign lawyer and then international arbitration partner with a leading Chinese law firm in Hong Kong, Fangda Partners between 2014 and 2019. Michael Bowes QC was recently invited to speak as a ‘thought leader’ on economic crime for RUSI, a major UK think tank.  The Royal United Services Institute for Defence and Security Studies (RUSI) is a major British defence and security think tank. They have launched an Economic Crime Plan Thought Leadership Series and in the fourth of this series, Michael argues that many of the right laws and structures are in place to enforce economic crime law, but that more needs to be done to put these into practice effectively. John McKendrick QC appears in latest adult international protection proceedings

John successfully appeared for the respondent before the High Court in AB v XS [2021] EWCOP 57, before Mrs Justice Lieven. The proceedings, in late October, concerned the welfare of an elderly lady, a British and Lebanese citizen, resident in Beirut, Lebanon. The application sought an order for the return of the lady from Beirut to England and Wales. Lieven J agreed with John’s submissions that she was habitually resident in Lebanon and therefore by application of section 63 of the Mental Capacity Act 2005, orders could not be made under the 2005 Act and that the exercise of the Inherent Jurisdiction on the basis of her British citizenship was inappropriate.
