Stephen Climie and Ben Bradley achieve substantial CICA award for Australian national

Two members of Chambers (instructed by Rebecca Dixon of Stewarts Law LLP) have recently been involved in assisting an Australian national to obtain a significant award before the First-Tier Tribunal (Criminal Injuries Compensation). The Appellant was injured in an unprovoked attack in London in 2004, which caused the client to suffer a brain injury. The CICA had initially contended that the Appellant was not entitled to any form of award at all by reason of his alleged conduct prior to the incident. Charles Foster and Ben Bradley in ‘Right-to-Die’ Litigation

This morning the Court of Appeal handed down judgment dismissing the appeal of Paul Lamb and Jane Nicklinson, but upholding the appeal (by a majority) of AM. Charles Foster and Ben Bradley were instructed by Barlow Robbins LLP to intervene in both appeals on behalf of the Care Not Killing Alliance. Paul Lamb sought to expand the doctrine of necessity so as to provide a defence to anyone who, at his request, killed him. Both he, and Jane Nicklinson (bringing an action in her own right, and on behalf of the estate of her late husband) averred that the current state of law of murder is incompatible with their respective Article 8 European Convention rights. Charles Foster and Ben Bradley, instructed by Barlow Robbins, are currently intervening in the conjoined appeals of AM, Nicklinson and Paul Lamb, on behalf of the Care Not Killing Alliance. The case is being heard before the Lord Chief Justice, the Master of the Rolls and Elias LJ in the Court of Appeal. It has has attracted international media attention. Ben Bradley obtains maximum CICA award

Ben Bradley (instructed by Irwin Mitchell LLP, London) obtained the maximum CICA award of £500,000 for his brain injured client; the initial CICA offer having been just over £20,000. The assessment of the severity of the Claimant’s injuries; the quantification of his loss of earnings and the value of his claim for ongoing care all remained in dispute on appeal.

Ben Bradley acts in Swine Flu inquest

Niyousha Haki, 28, from Birmingham died from pneumonia after contract Swine Flu during the pandemic in the Winter of 2010. She was seen by ambulance staff on 3 separate occasions prior to her death, but was not taken to hospital.

Ben Bradley obtains 4 separate Rule 43 recommendations in Article 2 inquest

Following a 4 day inquest, Ben Bradley, instructed by Christian Khan to represent the wife of the deceased, successfully invited HM Coroner for NW London to make 4 separate rule 43 recommendations (including a recommendation to the Secretary of State for Health). The inquest concerned issues relating to mental health assessment in custody and in the community. The coroner recorded a narrative Middleton verdict. In due course, the coroner will make various rule 43 recommendations relating to the use of holding powers whilst a formal Mental Health Act assessment is being awaited; and will make recommendations to improve communication and reduce delay when such assessments are requested.

Charles Foster and Ben Bradley in the Nicklinson ‘right to die’ litigation

Charles Foster and Ben Bradley, instructed by Barlow Robbins, represented Care Not Killing, an alliance of organisations opposed to any change in the law relating to assisted dying, in the recent conjoined cases of Tony Nicklinson and ‘AM’. The case attracted international media attention. Tony Nicklinson has locked-in syndrome. He wishes to die. He cannot kill himself. He seeks to expand the doctrine of necessity so as to provide a defence to anyone who, at his request, killed him. He says that: (a) the common law can and should – quite apart from any ECHR considerations – evolve to provide this defence; and (b) that Article 8 of the ECHR compels such an extension. Ben Bradley obtains rule 43 recommendation in respect of Ambulance Service practice

Ben Bradley, instructed by Anthony Gold to represent the family of the deceased, successfully invited HM Coroner for NW London to make a rule 43 recommendation to the London Ambulance Service (“LAS”). LAS currently automatically cancels ambulances in circumstances where patients are triaged into the lowest category of severity. The coroner will ask LAS to review the manner in which it communicates this cancellation to service-users. At present, service-users could be left with the impression the ambulance is still on its way. The coroner was not critical of LAS but has recommended that their systems be reviewed.
