Tom Gibson & Nicholas Hill appointed Junior Counsel to the Crown

We are pleased to announce that Outer Temple members Tom Gibson and Nicholas Hill have been successfully appointed to the Attorney General’s C Panel of Junior Counsel to the Crown. The appointments are effective as of 29th February 2016, for the duration of five years.

Matthew McDonagh secures acquittal of senior equities trader

Matthew McDonagh successfully secured the acquittal of Vincent Walsh, a former senior equities trader at RBS. Mr Walsh had been charged with an alleged conspiracy to cheat the Inland Revenue amounting to millions of pounds of tax relief generated by investment in the British Film Industry. He was acquitted following an eight-week trial that concluded just before Christmas last year. Other defendants in the case who were convicted have now received substantial sentences following their involvement in the conspiracy. Miranda de Savorgnani interviewed by LexisPSL on a ECJ case

Miranda de Savorgnani recently gave an interview to LexisPSL on a recent European Court of Justice case, ruling under the Brussels I Regulation, Aannemingsbedrijf Aertssen NV & Another Company v VSB Machineverhuur BV & Others: C-523/14 [2015] All ER (D). The case clarifies that ancillary civil matters brought in the context of criminal proceedings qualify as civil proceedings in their own right under Brussels I and Brussels I (recast). The amendments to Brussels I will assist the determination of the time when a court is first seised, by requiring greater cooperation between courts.

Robert Rhodes QC has been given the 2016 Corporate International Magazine Global Award of “UK-China Arbitration Barrister of the Year in England”. Robert is on the panel of arbitrators and mediators of several Far Eastern arbitration and mediation bodies.

Patrick Sadd questions Lenny Harper in Jersey Care Inquiry

Politicians and corrupt police officers were accused yesterday of covering-up the systematic child sex abuse by paedophiles on Jersey. Patrick Sadd, Counsel to the Inquiry, questioned Lenny Harper, retired Deputy Chief Officer of States of Jersey Police, who told the official inquiry that yachtsmen were “loaned” vulnerable children to abuse. Gordon Bebb QC & Cara Guthrie secure settlement of £9m+

Gordon Bebb QC and Cara Guthrie have recently acted for a 19 year old female Claimant who suffered from Ataxic Cerebral Palsy. Crucial to the value of her claim was the Claimant’s severe behavioural and psychological problems requiring 24-hour support. The valuation reflected the fact that she was likely to have children and would need additional support when looking after those children. The case settled for a lump sum of £3.25m and annual periodical payments of £184,600.

Tim Green considers the penalties imposed for Health & Safety offences

Tim Green considers the penalties imposed for Health & Safety offences, against those for financial misconduct in ‘The Lawyer Monthly’. According to his article in ‘The Lawyer Monthly’, Tim believes that ‘With the coming into force on 1 February 2016 of the Sentencing Council Guidelines for health and safety offences and corporate manslaughter, the financial penalties for companies with a turnover of £50m+ which are convicted of serious health and safety offences will increase from around £250,000 to over £2.5m.’ Tim is a member of both the health and safety and financial services groups at Outer Temple Chambers, both of which are highly recommended by the recent editions of the legal directories.
